WHO WILL BELL THE CAT?
What a great country is ours? Even the rights of prisoners are protected by politicians in power!!!! Hon’ble Prime ministers DPPG&P officials are not initiating any action over the fraud committed by the Commerce Ministry. Commerce Ministry deprived the fundamental pension rights of over 800 employees covered under CCS Pension Rules of 1972 by a stealthy executive fiat which was edited by officials to cheat the employees.
In spite of the existence of corrupt politicians like Madhu Kodas, financial scams, land scams, fake encounters, corrupt officials, black sheep’s we still believe in Indian judiciary & the powerful media to highlight our plight.
Irony- even though much trumpeted citizen’s charter for grievance handling system is established by the government, personnel at the realm have not been tuned to perform. Who will activate it? When will I get the Justice?
RTI Act-2005 exposed the constitutional fraud committed by commerce ministry yet bureaucrat machinery blocks the restoration of our pension rights.
Will the media bell the cat?

Will you kindly turn your attention to my letter under reference No. (i) cited above? Two months have passed since you received my letter i) and the copy of letter under reference (ii) and the copy of circular under reference (iii) which are clear proofs of infringement of EIC/EIA on your powers. But I am sorry to state that till date I have not been favoured with your reply.
In the meantime, I had an opportunity to go through your Office memorandum under Ref. F. No. 27/8/2007/EO/S.M.II of Govt. of India, Ministry of Personnel, Public grievances and pensions (Department of Personnel and Training) dt. 8th December 2007 wherein you had clearly mentioned that if any Ministry/Department resorts to violation of Allocation of Business Rules and if such violation is brought to the notice of D.O.P.T., the D.O.P.T, will treat it as non-est and shall be authorised to declare the same as NULL & VOID (Rahul Sarin).
From my letter under ref (i) and the copies of letters under ref (ii) and (iii) I have brought to your notice such a violation (infringement by Export Inspection Council and Export Inspectyion Agency (EIC & E.I.A.) on your powers). So, I request you to treat the circulars by E.I.C. and E.I.A. as NULL & VOID and declare the same accordingly. Further the sending out of employees by the E.I.C./E.I.A. on V.R.S. may please be treated as ILLEGAL and restoration of PENSION RIGHTS to V.R.S. Victims may be ordered and the STATUS QUO prior to the circular under ref (ii) may be brought to effect to all the past employees of E.I.C./E.I.A. who were affected by V.R.S. While declaring the circulars and subsequent actions of the E.I.C./E.I.A. as NULL & VOID I may please be given a copy of such a declaration against E.I.C./E.I.A.

Systems of Grievance redress machinery, Directorate of public grievances & right to information act-2005 have become a mockery.
Commerce ministry officials committed a big fraud on the govt. employees in the name of SVRS-1994.

RTI ACT EXPOSED THE COMMERCE MINISTRY’S FRAUD ON EMPLOYEES, YET NO ACTION INITIATED FROM HON’BLE PM’S DEPARTMENT OF PERSONNEL & TRAINING (DOPT)
FULL STORY OF AN ENCOUNTER
HOW THE COMMERCE MINISTRY VIOLATED THE CONSTITUTION!!!
I was a govt. employee of Export Inspection Agency-a statutory body under Commerce Ministry, covered by CCS Pension Rules of 1972.In 1994 over 700 employees opted for SVRS & govt. partly settled retirement benefits till 1997. We filed cases for not effecting full payment of attended benefits.
Simultaneously after 11years of my efforts I got an original circular of Commerce Ministry dt.21/05/1994 under RTI Act-2005 which exposed that the 1994-VRS scheme itself is not an approved one by the Nodal depts. Also the commerce ministry’s executive fiat which was circulated among employees was deliberately edited by the officials to cheat the employees. So the circular is NULL & VOID & the scheme is ILLEGAL as the Commerce Ministry has violated all the constitutional provisions.
From 2005 I have been approaching various govt. agencies for Justice. With no tangible solutions forthcoming I filed a fresh writ in Madras high court which is still pending. My efforts for a negotiated settlement also failed. My appeals to the Hon’ble PM-incharge of ministry of Personnel, Public Grievance & Pension, and the Hon’ble President-custodian of Pension Act-1871 did not receive the attention.
Pension is not a bounty and ministry officials cheated the employees by circulating an executive fiat which suppressed the facts to deprive our fundamental right to pension. When one time legislators demand pension, the govt. employees who have worked for over 20years have been fooled by the fraudulent SVRS-1994 circular.

This is a classic example to prove that much trumpeted grievance handling system of the Govt. of India is just a FARCE.

From 1994 I have not received any reply for over 100 messaegs/appeals/faxes sent asking for information on VRS-1994 but thanks to RTI Act-2005 for getting the original circular of commerce ministry which was edited to cheat the employees.
Export Inspection Council-a statutory body under Commerce Dept. which is also an “administrative ministry” implemented a special voluntary retirement scheme (SVRS)in 1994 fraudulently without involving the NODAL departments-in violation of Allocation of Business Rules & Transaction of Business Rules made by His Excellency The President of India under Article 77(3) of Indian Constitution.
Thus ILLEGAL SVRS-1994 has floated all rules/norms applicable under CCS Pension Rules of 1972 in gross violation of Articles 309, 313, 372 &144 of the Constitution.
This clandestine action is being covered by the following departments willfully for reasons best known to them:
1.Department of Personnel & Training.
2.Department of Pension & Pensioners Welfare.
3.Department of Administrative Reforms & Public Grievances.
4.Central Information Commission.

47. 10.10.2005 EIC finally replied with a letter Dt.21.05.1994 from Ministry of Commerce which admitted that this SVRS-1994 is not approved by the Govt. Of India. In spite of the Govt. refusal for SVRS-1994 The Commerce Ministry has arbitrarily/hurriedly/deliberately implemented the SVRS without involving nodal agency (DPT) in gross violation of Article 77(3) 309 of the Constitution. Hence this ambiguous SVRS-1994 circular Dt.21/5/1994 implemented by Commerce Ministry is ILLEGAL as it has violated the CCS Pension Rules of 1972 & the Articles 309,313,372 and 144 of the Constitution.
Though the scheme was claimed as VOLUNTARY, I was forced to submit the option Vide letter no: EIA: MS/Admn/gen/94-95/1134 dt.31.5.1994 even before clarifying the terms of the scheme on my first query Dt.30.05.1994.
SVRS-1994 circular dated 21st.May 1994 circulated by EIC deliberately omitted the facts contained in the ministry circular. Thus I have been deprived/kept in dark deliberately from opting Normal VRS under CCS pension rules.
I would not have opted this ILLEGAL SVRS-1994 had I received the original ministry’s circular (unedited by EIC).
So I am prepared to REPAY SOCALLED INCENTIVES received by me to ACCEPT THE NORMAL VRS Pension under CCS pension rules.

As the 1994-SVRS is illegal, DOPT has to take corrective measures by suitable directions to the Commerce Ministry to issue my pension payment order (PPO for Normal retirement benefits or as per 2002 SVRS circular) from the date of my relief-19.07.1994.

CALLOUS ATTIUDE OF DOPT/DARPG
Hon’ble Presidentji,
Sub: Illegal VRS/Clandestine actions by Commerce Ministry
Namaste. You are the custodian of Pensions Act-1871 which protects the rights of pensioners. I am a senior citizen not begging for alms but fighting for my pension rights (covered by CCSPension Rules-1972).
Export inspection agency, under the Commerce Ministry has fraudulently introduced a SVRS in 1994 without involving the DOPT (department of personnel & training) in violation of Constitutional provisions-Art.77/3.
DOPT under the direct control of the Hon’ble Prime Minister is avoiding its responsibility. Instead of using its Super ordinate powers to declare the Subordinate Commerce Ministry’s SVRS-1994 circular( an executive fiat) as NULL & VOID, pushing me from pillar to post.
I am prepared to surrender my ILLEGAL benefits received with interest to accept my normal retirement benefits (47A) which is permitted by treasury rules.
I request you to end my long agony by directing DOPT to redress my grievance expeditiously.
